Avoiding conviction on a DWI or DUI charge is not always a realistic possibility. Even when it is, in fact – a conviction might still result. Even the best criminal defense lawyers don’t “win” every time out.

Minimizing The Damage of a DUI Conviction

DUI Sentencing Alternatives

First-time offender status is often key to securing favorable sentencing options. However, whether this is your first DWI, your second or your fourth, attorney Zohlman’s personal knowledge of what it means to be a prosecutor can be helpful in minimizing the consequences of a new conviction.

  • Alternatives in a first offense: On a first offense, we strive to help clients receive two days in a New Jersey IDRC (intoxicated driver resource center) facility and a drivers’ license suspension period that is closer to the minimum of three months than the maximum one year.
  • Alternatives if it has been more than 10 years since your arrest: If you have been convicted of a DWI (whether in New Jersey or any other state) but it has been more than 10 years, it may still be possible for you to be treated as a first offender by the court. In some cases, Mr. Zohlman has successfully been able to go back to the original court and get the case opened, overturned, or expunged – or the level of your offense reduced the offense by one.
  • Alternatives for a second DWI offense: Even if this will be your second DWI conviction, avoiding jail time may still be possible. At this level, you will have to spend at least four days in an IDRC facility. However, Mr. Zohlman will work to see if any additional jail time requirements can be met through probation, house arrest, weekends only or a SLAP (sheriff’s labor assistance program) program placement that allows for work release.
  • Alternatives for a third offense: If this will be your third offense, you may have to serve 180 days in jail. However, we can help you apply to serve up to 90 days of that time in a qualified alcohol or chemical dependency treatment program before or after incarceration.
