New Jersey ERISA Claims and Long Term Disability Insurance
The Early Retirement Income Security Act of 1974 (ERISA) is a federal statute that governs the administration of employee benefits plans — outlining the rights and responsibilities of employers, beneficiaries, and insurance providers under any plan.
Commonly, despite their role under ERISA, insurance companies deny benefits to individuals for a variety of reasons. The federal statute allows for administrative appeals and — once the insured exhausts the administrative remedy — courtroom claims. Unfortunately, under the guidelines established by ERISA, filing a claim and finding the benefits you are entitled to can be a complex process, as can bad faith and breach claims against private insurers in state courts.
Designing a successful approach to appealing a denial requires specific steps be followed and involves complicated issues, such as the medical characteristics of an injury or illness and the occupational characteristics of an individual’s employment.
